Sarah Palin's email leads to Alaska high court ruling

4 hrs.

ANCHORAGE, Alaska (Reuters) - Alaska state employees can use private email accounts for public business but the messages must be preserved under public-records laws, the Alaska Supreme Court ruled on Friday in a case stemming from ex-Governor Sarah Palin's communications practices.

Palin is out of office but the ruling could affect her successor, Governor Sean Parnell, who is involved in his own controversy over public records. Critics have accused Parnell and his aides of using text messages rather than official emails to keep communications out of public view.

Electronic messages about state business are no different from paper communications under the Alaska Public Records Act, the Alaska Supreme Court said in its unanimous 16-page written decision that largely upheld a lower court ruling.

All paper or electronic messages regarding state business must be preserved and made available for public review, in accordance with state law, "and that duty cannot be extinguished by a public official's unreviewable decision simply not to preserve them," the court said.

A spokeswoman for Parnell said that his administration viewed the court's ruling as "favorable."

"Text messages are, by their nature, transitory, so they wouldn't be appropriate for preservation or constitute public records," Parnell's press secretary, Sharon Leighow, told Reuters in an emailed statement.

Friday's decision resulted from a lawsuit filed in 2008 by Andree McLeod, an Anchorage activist who criticized Palin, the Republican nominee for vice president that year, for using private Yahoo accounts to communicate state business.

She and others contended that Palin used private accounts to evade state public-records rules. McLeod also argued that no state business should be conducted on private email accounts.

Open-records requests filed by McLeod and several journalists resulted in release of thousands of pages of Palin emails during her term as governor, many of them from her private accounts. The emails were released in 2011 and earlier this year, long after Palin resigned her post in 2009.

Friday's ruling, though it partially affirmed the lower-court ruling protecting the use of private emails, is a victory for McLeod, her attorney said.

"The Alaska Supreme Court's decision this morning demonstrates the importance of what citizen activists such as Andree McLeod can accomplish to advance the interests of all Alaskans in ensuring that all state employees, from the governor on down, conduct official state business in a manner that at all times and through all means of communication serves the public interest," attorney Don Mitchell said in a statement.

An August 27 opinion by the state legislature's legal adviser concluded that text messages are subject to state public records laws. Parnell's spokeswoman said at the time that the governor disagrees and considers text messages to be "transitory in nature" and difficult to preserve.

A representative for Palin could not immediately be reached for comment.

Customize Your Own Journal, Planner, and More ? The Lilypad ...

Have you heard of Paper Coterie?yet? If not, run over there right now. Well, as soon as you finish reading this post, of course. This site offers beautiful customizable journals, planners, calendars, cards, memory boxes, and more.

And no, this is not even a sponsored post ? I ordered my own planner recently and I LOVE it! And right now, Paper Coterie is generously offering a $40 credit for first time customers, using the code FBFORTY. The catch is, they only brought back this offer for an extremely limited time ? the code?FBFORTY?expires tomorrow, 10/14/12.

You could get yourself a new journal, order a bunch of Christmas cards, create a couple calendars for family, whatever you want. The monthly planner that I bought is $34 regular price, which means I got this beauty, filled with photos of my family, FREE (you do pay shipping, which cost me $7).

(Please excuse the photo quality, I snapped these pictures late at night with my iPhone! Oh, and the scribble on the cover was an aftermarket addition :) .)

For some of the photo pages mixed into the planner, or even the cover, I?m sure a digital scrapbook layout would look fabulous! The planners are 8?x8?, coilbound with a plastic cover (to protect photo page) and hard back and come in weekly and monthly editions. The journals are similar style, 6?x8?, and are available in coilbound or hardcover. I appreciate the thickness and heft of the paper, too. No flimsy, thin pages here!

Another of my favorite features is that these planners are tailored to memory keepers. In addition to the classic, roomy calendar squares and note space, there?s a spread each month with spaces for a to-do list, ?favorite moments,? ?a funny thing happened,? ?10 things I am grateful for,? and ?ramblings.? I plan to make good use of these prompts to, well, ?prompt? my memory for future scrapbook pages and my 2013 Project Life album.

Before you hurry off to customize your own goodies (which is similar to creating a photo book, just upload your photos, drag-and-drop them onto the templates, and customize your text and text box placement), I wanted to show you a few more of my favorite things on their site. I wish I could be a first-time customer again!

I think these swatch cards are the cutest idea ever. It?s a mini keepsake all by itself!

Looking for the perfect Christmas countdown calendar? These fabric repositionable posters come in 2 sizes.

The perfect solution to corral the ?stuff? ? kids? artwork, museum tickets, special trinkets, etc. These ?Memory Keeper? boxes come in 10?10 and 10?13 sizes and plenty of choices for cover design. I want one for each kid!

This is really just a tiny sampling of the pretty eye candy on this site. I hope you are able to use the $40 credit, and if you do, please come back here and let us all know what you chose!

Wells Fargo earnings rise in 3Q as loan book grows

Wells Fargo posted record earnings in the third quarter as the bank increased mortgage lending and pocketed more fees.

Wells, the nation's biggest mortgage lender, expanded its loan portfolio by making new loans to consumers. It collected more interest on loans than in the same period a year earlier.

Revenue was lower than analysts were expecting, however, and Wells' stock fell 3 percent.

Wells' booming mortgage business accounted for much of its strength in the quarter. Fees from the bank's booming mortgage business added to its revenue. New mortgage loans originations rose to $139 billion from $89 billion in last year's third quarter.

"Real estate is getting better," Wells Fargo chairman, CEO John Stumpf said on a call with analysts. "We saw it in housing, and every quarter we have more confidence."

Wells' net income in the quarter ended Sept. 30 rose 23 percent, to $4.72 billion from $3.84 billion in the same period last year.

That amounts to 88 cents per share, a penny higher than the average estimate of analysts surveyed by FactSet. Wells earned 72 cents per share in last year's third quarter.

Overall revenue rose 8 percent to $21.21 billion, slightly lower than analysts expected. Wells' stock fell $1.07, or 3 percent, to $34.11.

Net interest income, which includes interest on loans, edged up 1 percent to $10.66 billion from $10.54 billion.

Non-interest income, which includes fees, insurance and mortgage banking revenue, rose 16 percent. Card fees rose modestly, while mortgage banking accounted for the bulk of the increase.

That category also includes trading gains, another bright spot for Wells this quarter. Wells reported net gains from trading of $529 million, compared with a loss of $442 million a year earlier. Wells' trading business is smaller than those of its big competitors on Wall Street.

The stock fell mainly because analysts are concerned about Wells' ability make money on interest from loans that it originates. In a call with executives, most analysts focused on Wells' shrinking net interest margin ? the difference between interest it collects on loans and interest it must pay to depositors and other lenders. Wells' net interest margin fell to 3.66 percent from 3.84 percent a year earlier.

Wells said it offered $139 billion in new mortgages, compared with $131 billion in the second quarter and only $89 billion in last year's third quarter.

The bank decided to hold $9.8 billion of new, high-quality mortgages on its books instead of bundling and reselling them. Executives said the loans will generate better, safer returns over time than alternative investments like mortgage-backed securities.

Because it kept more loans, the bank's average outstanding loans to consumers rose 4 percent from the prior quarter, to $335.28 billion from $322.30 billion in the period ended June 30.

Wells also offered consumers more loans for autos, credit cards and education.

Average loans to companies rose from a year earlier, but declined slightly from the previous quarter.

More people parked their money at Wells, boosting core deposits by 7 percent from a year earlier, $895.4 billion from $836.8 billion a year earlier.

With more deposits on hand, banks have a stronger capital position and can lend more easily.

Wells, based in San Francisco, appears more confident that those loans will be repaid. It released $200 million that it had set aside earlier to cover possible loan losses.

One sign that loan repayments are improving: Wells gave up on collecting 1.2 percent of its average loan balance, down from 1.4 percent a year earlier.

On Tuesday, the federal government sued Wells Fargo, accusing it of misleading regulators about the quality of thousands of loans in order to qualify for federal loan insurance. The lawsuit seeks to recover hundreds of millions of dollars paid to Wells by the Federal Housing Administration after borrowers defaulted on their loans.

The earnings don't include dividend payments to preferred stockholders.

Analysis: Biden rekindles controversy over administration's Libya statements

WASHINGTON (Reuters) - The Obama administration's latest verbal bungle over the chain of events leading to the deadly attack in Benghazi, Libya, rekindled the controversy over the incident on Friday and offered new ammunition to Republican opponents.

In Thursday night's vice presidential debate, Vice President Joe Biden insisted that "we weren't told they wanted more security" at the ill-fated U.S. diplomatic mission in Benghazi, where U.S. Ambassador Christopher Stevens died.

Biden's statement, at least on the surface, appeared to contradict congressional testimony less than 48 hours earlier from State Department officials, and offered a fresh opening for Republican presidential challenger Mitt Romney, who has repeatedly sought to attack the White House over the issue.

It was the latest example of a White House, which has long prided itself on "message discipline," flubbing its own message on the Libya attacks. President Barack Obama and his aides have struggled to explain why they first described the violence as growing out of protests over an anti-Muslim movie, only later to acknowledge it was an organized attack by militants.

In a written commentary the day before Biden spoke, prominent national security analyst Anthony Cordesman said the administration had "fumbled the situation by going into a state of confused denial" about Libya. The administration should also have made a stronger case for establishing on-the-scene diplomacy in a volatile environment such as post-Gaddafi Libya, he wrote.

Cordesman also said the Republicans had turned the Benghazi events into a "gotcha" contest where the president is somehow blamed for "largely local security decisions."

The White House was quick to defend Biden on Friday, saying he had been speaking only for himself and Obama - in other words, not for anyone else in the administration who might have heard about the dangers facing Americans in Libya's relatively lawless second city before Stevens and three other Americans were killed on the night of September 11.

Romney went back on the offensive on Friday, saying Biden had contradicted the sworn testimony of State Department officials. "He's doubling down on denial," Romney charged.

REPUBLICAN CRITICISM FIRST TARGETED RICE

Biden's "we did not know" comment fed into Republican criticism that the administration had been less than truthful about a violent assault on U.S. interests during an election year in which Obama previously seemed to have the upper hand in foreign policy.

"We weren't told they wanted more security. ... We did not know they wanted more security" in Benghazi, Biden said in the debate with Republican vice presidential candidate Paul Ryan.

Until now, the Republicans had focused much of their fire about Libya on U.S. Ambassador to the United Nations Susan Rice.

Rice, speaking from talking points prepared by U.S. intelligence agencies, suggested a few days after the Benghazi events that the violence appeared to have been sparked by protests over the anti-Muslim video.

Bob Corker, a senior Republican on the Senate Foreign Relations Committee, said on Friday the administration had to have known right away that the assault on the mission was carried out by militants and was not triggered by a protest.

"Within 24 hours of the incident the administration knew that this was an orchestrated terrorist attack, and they clearly were aware of the specific details, including requests for additional security, that have finally been made public this week," Corker said in a statement.

"With the vice president continuing this ruse with his comments last night, all Americans should ask what the administration is trying to hide," he added.

At the congressional hearing on Wednesday, two U.S. security officers described their frustration that their requests for more security resources in Libya were ignored in the weeks and months before the assault on the Benghazi mission.

An official from the State Department's Bureau of Diplomatic Security acknowledged at the hearing that she had turned aside pleas for more security.

"I said personally I would not support it," the official, Charlene Lamb, said when asked about one particular request to extend deployment of a 16-person U.S. military team that left Libya in August, a month before the bloodshed in Benghazi.

White House spokesman Jay Carney said on Friday that Biden had been "speaking directly for himself and the president" with his comments about diplomatic security, not for the State Department, where Carney said such issues were "appropriately" handled.

Secretary of State Hillary Clinton also tried to smooth over the controversy, saying the administration was dealing with the best available information as it came in about the events in Benghazi.

"To this day - to this day - we do not have a complete picture. We do not have all the answers. No one in this administration has ever claimed otherwise," Clinton said at an appearance with visiting Italian Foreign Minister Giulio Terzi.

Cordesman, the analyst at the Center for Strategic and International Studies, said he did not believe Biden misspoke. He said the top echelons of an administration did not know all details of security requests that came in from "lots of crisis countries."

"This is the vice president of the United States, and you are talking about a security chain coming from one embassy, one consulate structure, in a highly unstable country," Cordesman, a former intelligence expert at the Pentagon, said in a telephone interview.

Owl City's ?When Can I See You Again?: Hear The Dance-Pop Track ...

The uptempo dance-pop song, taken from the soundtrack for the upcoming Disney film Wreck-It Ralph, features vocalist Adam Young?s light vocals over a bed of pounding drums and twinkly synths. ?As a huge fan of Disney animation films growing up, it was a real honor to write ?When Can I See You Again? for?Wreck-It Ralph,? he told?AOL Music. ?I felt like it was really challenging to try to live up to the Disney legacy. I had a blast.??Hear ?When Can I See You Again? after the jump.
